Proving cotton origin as regulation tightens in Europe and the U.S.

As Germany begins enforcing stricter anti-greenwashing rules and U.S. authorities continue action under the Uyghur Forced Labor Prevention Act (UFLPA), cotton sourcing claims are facing closer examination. Brands are now expected to demonstrate, with clear evidence, where their cotton comes from. Documentation alone is no longer enough.

A changing compliance landscape
Germany’s amended Act Against Unfair Competition, which implements the EU’s Empowering Consumers for the Green Transition Directive, now restricts vague or unsupported environmental claims. Companies can no longer rely on broad terms such as “sustainable” or “responsibly sourced” without solid backing.
At the same time, UFLPA enforcement in the United States places the burden of proof on importers. If there is any indication that cotton may be linked to forced labor, companies must provide credible evidence to clear their shipments. In recent years, shipments have been detained due to insufficient origin documentation.
These developments signal a clear shift. Regulators are not asking what companies intended to source. They are asking whether the cotton inside the product can be proven to originate from the declared region.
Linking fiber science with digital records

Addressing weak points in cotton supply chains
Cotton supply chains are long and often fragmented. Fibers may be blended during spinning or mixed during recycling. As a result, origin information can be diluted or lost early in the process. Downstream mills, garment manufacturers, and brands are still expected to make accurate origin claims to consumers and regulators.
This is where risk tends to accumulate. Certifications and transaction documents remain useful, but enforcement authorities increasingly test whether the material reality of the fiber matches the paper trail. Under both EU consumer protection law and UFLPA enforcement, documentation without physical validation has proven insufficient in some cases.
A dual-layer model physical testing plus digital traceability creates an additional layer of assurance. It can help brands detect sourcing risks earlier, prepare for audits, and maintain consistent disclosures across different markets.
From transparency to proof
The direction of regulation is becoming clearer. Transparency is no longer the final goal. Proof is.
As Digital Product Passports become mandatory in the EU and forced labor enforcement continues in the U.S., companies are expected to design traceability systems with regulatory scrutiny in mind. Claims must be limited to what can be substantiated.
